Retail Leasing Discussion Paper

Minister Tripodi released a discussion paper on 14 April 2008, outlining a range of issues and inviting submissions from the retail sector.

Submissions can be made by email, in writing or by telelphone.

Protect Your Lease

Protect Your Lease has advice for retail tenants on one of their biggest investments, their retail lease.

It explains some of the potential pitfalls around retail leasing, to encourage better business planning and improve tenants' leasing relationship with their landlords, and how to get help if there is a problem.

Retail Lease Security Bonds

The Retail Leases Act 1994 (NSW) requires all retail lease security bonds to be deposited with the Director-General. Bank guarantees are not affected by the operation of the Act.

Landlord (or agents) may be liable for a penalty of up to $2,200 if they do not comply.

Bonds can only be lodged using only an approved form – Email rtu@business.nsw.gov.au to order an approved bond lodgement form. Bond forms will be posted within a week of the order.

Retail Tenant's Guide
The Retail Tenant's Guide must be given to the tenant, with a copy of the proposed lease, at the commencement of negotiations.
